1. Acceptance of Terms
These Terms of Service (the "Terms") constitute a legally binding agreement between PWA-MEDIA LLC ("Company," "we," "us," or "our") and you, whether personally or on behalf of an entity ("User" or "you"). These Terms govern your access to and use of the Argus platform, located at argus101.com, and any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Service").
By accessing the Service, you represent that you are at least 18 years of age. If you are under 18, you must have parental or guardian consent to use the Service. If you are using the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.
IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
2. Definitions
- "Argus Score" refers to the probabilistic lead quality score (0-100) generated by our proprietary algorithm.
- "User Data" refers to any information, leads, or data points submitted by you to the Service for verification.
- "Documentation" refers to the online technical documentation, user guides, and help materials maintained at argus101.com.
- "Verifications" refers to the individual lead analysis events performed by the Service, including email validation, phone validation, and behavioral analysis.
3. Account Registration and Security
3.1. Accuracy of Information. To access the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2. Account Responsibility. You are responsible for safeguarding your password and any API keys assigned to you. You agree not to disclose your password or keys to any third party. You are solely responsible for any activities or actions under your account, whether or not you have authorized such activities or actions.
3.3. Account Uniqueness. Unless otherwise authorized in writing by PWA-MEDIA LLC, you may only maintain one account per person or organization. Multi-account "stacking" to circumvent free tier limits is strictly prohibited.
3.4. Unauthorized Access. You must immediately notify PWA-MEDIA LLC at support@argus101.com upon becoming aware of any breach of security or unauthorized use of your account.
4. Service Description and Limitations
4.1. Scope of Service. Argus provides a SaaS platform for lead verification and fraud detection. Our system analyzes 101 distinct data points per lead submission, including but not limited to IP geolocation, VPN/proxy detection, device fingerprinting, and behavioral analysis. By creating an account, you also consent to receive transactional and marketing email communications from Argus. You may opt out of marketing communications at any time, but transactional emails related to your account operation cannot be disabled.
4.2. Probabilistic Nature. You acknowledge that the Argus Score and associated verification data are probabilistic assessments based on statistical patterns and third-party data. We do not provide a guarantee that any lead is "100% real" or "100% fraudulent."
4.3. Uptime Commitment. While we strive for high availability, we do not guarantee that the Service will be uninterrupted. We strive to maintain commercially reasonable uptime for the Service, excluding scheduled maintenance.
4.4. Changes to Service. We reserve the right to withdraw or amend the Service, and any material or feature we provide on the Service, in our sole discretion without notice.
5. Pricing, Billing, and Refunds
Current pricing and plan details are available at argus101.com/pricing. Pricing is subject to change with 30 days' notice to active subscribers.
5.1. Payment Processing. All payments are processed through Stripe. By subscribing, you authorize PWA-MEDIA LLC to charge your provided payment method for the recurring monthly fee associated with your selected tier.
5.2. Upgrades and Downgrades. Plan upgrades take effect immediately and are prorated for the current billing cycle. Downgrades take effect at the end of the current billing cycle.
5.3. Exceeded Limits. Our Service is feature-gated. If you exceed your monthly verification limit, the Service will cease to process new verifications until the next billing cycle or until you upgrade your plan. No overage charges are applied automatically.
5.4. Refund Policy. PWA-MEDIA LLC generally does not provide refunds for partial months of service or for unused verification credits within a billing cycle. Exceptions may be considered at the sole discretion of PWA-MEDIA LLC on a case-by-case basis.
6. Acceptable Use Policy
You agree not to use the Service to:
- Conduct any illegal activity or violate any local, state, national, or international law.
- Engage in spamming or send unsolicited communications using data verified through Argus.
- Reverse-engineer, decompile, or attempt to extract the source code or scoring algorithm of the Service.
- Resell or sublicense the verification services to third parties without express written authorization.
- Submit "dummy" or "test" data into production environments to manipulate or "fuzz" the scoring algorithm (except through the designated Test Mode).
- Use automated scripts or scrapers to access the dashboard beyond the intended UI capabilities.
- Violate the privacy rights of individuals, including non-compliance with CAN-SPAM, TCPA, CCPA, or GDPR.
7. API and SDK Usage
7.1. License to Use. We grant you a limited, non-exclusive, non-transferable license to use our API and JavaScript SDK solely to integrate the Service into your applications.
7.2. Rate Limiting. We implement rate limits to ensure service stability. Rate limits are tied to your subscription tier. Abuse of the API through excessive requests may result in temporary or permanent suspension of your API access.
7.3. Credential Security. You are solely responsible for the security of your API keys. If your keys are compromised, you must rotate them immediately via the Argus dashboard.
8. Intellectual Property Rights
8.1. Company Ownership. PWA-MEDIA LLC owns all right, title, and interest in and to the Service, including the Argus scoring algorithm, software, code, branding, logos, and Documentation. You may not copy, modify, or create derivative works of any part of the Service.
8.2. User Data Ownership. You retain all rights to the User Data (the lead information) you submit to the Service. By submitting User Data, you grant us a worldwide, non-exclusive, royalty-free license to process this data solely for the purpose of providing the verification service to you.
8.3. Aggregated Data. We may aggregate and anonymize data from your usage to improve our scoring algorithms. This data will not contain any Personally Identifiable Information (PII) belonging to you or your leads.
9. Data Accuracy Disclaimer
Critical Notice:
Argus verification results are based in part on third-party data sources and behavioral signals. We do not guarantee the absolute accuracy of email validation, phone validation, or geolocation data.
Users should not rely solely on Argus Scores for critical business decisions. You acknowledge that PWA-MEDIA LLC shall not be held liable for any business losses, missed leads, or fraudulent activity that occurs despite a high Argus Score.
10. Termination and Data Retention
10.1. Cancellation by User. You may cancel your subscription at any time via the account dashboard. Cancellation will stop future billing but will not entitle you to a refund for the current period.
10.2. Termination by Company. We reserve the right to terminate your account immediately, without notice, for any breach of these Terms, including non-payment or violation of the Acceptable Use Policy.
10.3. Data Retention. Following cancellation or termination, we will retain your account data for 90 days to allow for account reactivation. After this 90-day period, all User Data and logs associated with your account will be permanently deleted from our production servers.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PWA-MEDIA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
In no event shall our total liability for all claims related to the Service exceed the total amount of fees paid by you to PWA-MEDIA LLC during the twelve (12) months immediately preceding the event giving rise to the claim.
We are not liable for failures caused by third-party services integrated with Argus, including but not limited to Stripe, Twilio, or cloud infrastructure providers.
12. Indemnification
You agree to defend, indemnify, and hold harmless PWA-MEDIA LLC and its employees, contractors, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
- Your use and access of the Service;
- A breach of these Terms;
- Your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right;
- Any claim that your User Data caused damage to a third party.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PWA-MEDIA LLC MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS.
14. Dispute Resolution and Arbitration
14.1. Governing Law. These Terms shall be governed and construed in accordance with the laws of Utah, without regard to its conflict of law provisions.
14.2. Binding Arbitration. Any dispute arising from these terms shall be resolved through final and binding arbitration under the rules of the American Arbitration Association (AAA).
14.3. Class Action Waiver. YOU AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED IN YOUR INDIVIDUAL CAPACITY ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice for any material changes by posting the new Terms on this site and sending an email to our active subscribers. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
16. Miscellaneous Provisions
16.1. Entire Agreement. These Terms constitute the entire agreement between you and PWA-MEDIA LLC regarding the Service.
16.2. Severability. If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law.
